If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this website.


1) Ordering procedure
You are deemed to place an order with us by ordering via our online checkout process. As part of the checkout process, you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.
Our acceptance of an order takes place when the order is despatched to you. We will send you a despatch confirmation by email. Unless we have notified you that we do not accept your order, or you have cancelled your order, the purchase contract will be made even if your payment has been processed immediately.
When buying goods and services on the internet, a customer is entering into a legally binding contract.


2) Pricing
All prices for our products are stated on this website and are inclusive of delivery on our standard delivery service (ParcelForce Express 48 hours or UK Mail). Our prices are inclusive of any VAT.
We reserve the right to amend prices without notice.


3) Products
Whilst every effort is made to keep our website as up to date as possible, some products may vary from those displayed on the website. We reserve the right to make product changes without notice at any time. All labels will contain legally required information regardless of design options.


4) Availability
In the event of us having insufficient stock to satisfy your order at the time of entry, we will suggest the likely possible delivery date of your order. You will then be able to place an alternative order for another product, or accept this likely delivery date and continue with your original order.


5) Delivery
Our standard delivery is ParcelForce Express 48hours or UK Mail anywhere in mainland UK for orders taken before 15:00 UK local time. Our courier, Parcelforce & UK Mail, achieve over 95% of deliveries within this timeframe.
In case the recipient is not in when our courier calls, you can elect to have the parcel left with a neighbour, (a neighbours signature maybe required), or taken to a local Post Office for collection or re-delivery. We will not be liable for delivery discrepancies arising from these options. In all cases, the delivery driver will leave a card at the intended recipient's address detailing the location of the parcel and where it can be collected. In the case of cancelled orders, the outbound delivery cost will be charged at £9.00 + VAT at the standard rate.
Non UK mainland deliveries. Please use our online contact form to make all non UK mainland orders.


6) Damages and complaints
Any complaint you have with our products our services should be addressed to us by using our online contact form. All of our products should reach their intended recipients in perfect condition. In the unlikely event of breakage, this must be recorded on the drivers delivery paperwork. In the event of a defective product, we will require the product to be sent back to us which we will arrange. In either case, we must be notified within seven days of delivery via our online contact form quoting your order number.


7) Cancellations
An order may be cancelled for up to seven days after the day following receipt of the goods. To cancel an order, we must be informed in writing quoting your order number using our contact form within seven days of the day following your receipt of the goods. We will be unable to issue any refunds for the product unless it is returned to us in saleable condition. We are unable to refund any carriage costs either for the original despatch or for the cost of return in cases of order cancellation.


8) Payment
We accept the following major credit and debit cards: Visa, Maestro, Delta, Mastercard. All card transactions are extremely secure. For all security details, please visit PayPal. PayPal processes all credit card transactions made via this website; Maynard House Orchards does not get passed your credit card information.
We will not despatch any goods until the normal checks and authorisations have been completed.
We may refuse to accept an order where we cannot obtain authorisation for your payment.


9) Data Protection
We comply with The Data Protection Act 1998. We will not sell your personal information to any third party for any reason.


10) Service access
We endeavour to ensure that this website is available 24 hours a day. However, we will not be liable if for any reason it is unavailable at any time or for any period.
Access to this website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.


11) Privacy
We respect your privacy and will treat all information as confidential.
When you shop on the Maynard House website, we will ask you to enter data such as your name, email address, billing address, delivery address, telephone number, product selections, credit card or other payment information or special instructions to service your order.
Please note that we will not pass on your details to third party organisations and that your personal details are held securely and in strict confidence. We only use your information for the following purposes:
To process your order(s)
To inform you of new products or promotions that may be of interest to you upon your consent
To analyse website statistical information and improve administration of the website


12) Liability
We or any other party (whether or not involved in creating, producing, maintaining or delivering this website), and any of our group companies and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with this website in any way or in connection with the use, inability to use or the results of use of this website, any websites linked to this website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing this website or your downloading of any material from this website or any websites linked to this Website.

These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
